Energy Policy Act Tax Deductions Extended to 2013
President Bush has signed into law an extension of the Energy Policy Act of 2005 that will continue to provide the $1.80 per square foot tax deduction for energy efficient commercial and industrial building upgrades through December 31, 2013. This five-year extension was passed by the Senate on October 1 by a vote of 74-25 and by the House on October 3 by a vote of 263-171 as part of the Emergency Economic Stabilization Act of 2008. The Energy Policy Act of 2005 provides valuable tax deductions for businesses that complete energy efficient upgrades on their lighting, HVAC or building envelope systems.  These deductions are available as either a $1.80 per square foot deduction for comprehensive measures that reduce the energy consumption by 50% as compared to the ASHREA 90.1-2001 standard or as a $0.60 per square foot deduction for each system that reduces energy consumption by 16-2/3% as compared to the same standard.
